Guiding principle: The applicant credit union alleged a violation of Article 1 of Protocol No. 1 (right to the peaceful enjoyment of possessions). The applicant credit union complained that the decisions concerning its receivership could not be contested before independent and impartial national authorities with full jurisdiction to examine its case. It also maintained that it had been deprived of access to a court while seeking to challenge the decisions extending the receivership. In its decision on admissibility adopted on 31 January 2006 the Court decided to examine these complaints under Article 6 § 1 of the Convention (right to a fair and public hearing by an independent and impartial tribunal). The European Court of Human Rights holds that there has been a violation of Article 1 of Protocol No. 1 to the Convention in respect of the applicant credit union and a violation of Article 6 § 1 of the Convention.
