Guiding principle: In view of the above-stated findings and conclusions, therefore,the Constitutional Court is of the view that the complainant did notlose his Czech citizenship as a consequence of the declaration he madeon 30 June 1993; consequently, he was not accorded protection from theactions of the administrative authority, which refused to issue him acertificate of his Czech citizenship, hence, the Municipal Court inPrague violated his constitutionally guaranteed rights enshrined inArt. 90 of the Constitution, as well as Art. 36 para. 1 of theCharter.
